Questions We Hear Most Often

The most common employer-sponsored options are H-1B for specialty occupations, L-1 for intracompany transfers, TN for Canadian and Mexican nationals, E-3 for Australian nationals, and O1A for employees with extraordinary ability. For permanent residency, PERM followed by EB-2 or EB-3 green cards is the standard pathway.
The employer files a petition with USCIS on behalf of the employee. Cap-subject H-1B petitions enter a lottery each April with a registration window in March. Cap-exempt employers including nonprofits, universities, and research institutions can file year-round. We manage the full process including LCA filing, petition preparation, and USCIS correspondence.
L-1A is for managers and executives being transferred from a foreign office to a U.S. entity. L-1B is for employees with specialized knowledge of the company's products, services, or procedures. L-1A holders are also strong candidates for EB-1C green cards, which require no PERM labor certification.
Yes. Startups can sponsor H-1B, O1A, L-1, and other visas as long as they meet basic employer eligibility requirements. Early-stage companies often use O1A for extraordinary ability hires as it offers a faster, more flexible path than H-1B without the lottery risk.
PERM labor certification alone can take 6 to 18 months. I-140 approval with premium processing takes 15 to 45 business days. The final green card step varies significantly based on visa bulletin priority dates, particularly for Indian and Chinese nationals in the EB-2 and EB-3 categories.
